TERMS & CONDITIONS / RETURNS POLICY

1. Scope

These Terms & Conditions (“Terms”) govern the sale of Fine Art Photography products via [Your Shop Name] (“we”, “us”, “our”) to consumers in the EU, Germany, Austria, and Switzerland. By placing an order, you agree to these Terms.

2. Made-to-Order Products

All products listed on this website are made to order or customized according to your specifications (e.g., size, finish, edition). Due to their bespoke nature, these products cannot be returned or exchanged once production has started or the order has been completed.

This exclusion of the right of withdrawal is in accordance with EU Directive 2011/83/EU and national consumer protection laws (e.g., § 312g BGB in Germany) for products that are clearly personalized or made to individual specifications.

3. No Right of Withdrawal / Return

As a customer, you acknowledge and agree that:

  1. You do not have a statutory right of withdrawal or return for products that are:
    • Individually produced or printed on demand
    • Custom-sized or custom-framed
    • Clearly tailored to personal requirements
  2. This exclusion applies only to private consumers. Business customers (B2B) do not have statutory withdrawal rights.
  3. For other standard items (if any), the general 14-day withdrawal period applies, starting from the day you receive the item.

4. Order Cancellation

Orders can only be cancelled before production begins. Once production has started, the order cannot be cancelled, refunded, or exchanged. Please contact us immediately at [email/contact] if you wish to attempt a cancellation.

5. Defective or Damaged Items

If a product arrives defective or damaged, please contact us within 14 days of delivery with photographic evidence. We will either:

  • Arrange a repair or replacement, or
  • Refund the product price, as appropriate.

Shipping costs for returns due to defects will be covered by us.

6. Shipping & Delivery

  • Shipping times are estimated per product description.
  • Risk of loss or damage during shipping passes to the customer upon delivery.

7. Payment

  • Payment is due at the time of order via the provided payment methods.
  • All prices include applicable VAT unless stated otherwise.

8. Governing Law & Jurisdiction

These Terms are governed by the laws of Austria, without prejudice to mandatory consumer protection laws that apply in the customer’s country of residence.
